HC stays deporting of 107 years old person who came back from POK after 41 years

Jammu, September, 22:- In a writ petition filed by one Nawab Din, who during 1965 gone to POK, seeking direction to respondents to allow him to reside in his native Village at Rajouri, Justice JP Singh of J&K High Court Jammu Wing today after hearing Advocate Sunil Sethi with Adv Shahzad Azeem issued notice to state of J&K through Chief Secretary, Union of India through Secretary, Ministry of Home Affairs, New Delhi, Commissioner/ Secretary to Govt Home Department J&K, Deputy Commissioners Rajouri and Poonch and DIG Police Rajouri Poonch Range, with the direction that till further orders from this Court, respondents shall permit the petitioner to stay at Village Raj Nagar, Budhal Tehsil Koteranka, District Rajouri and no steps be taken by the respondents to deport the petitioner.



In the petition it has been submitted that petitioner is an old man of 107 years of age, who unfortunately during 1965 aggression of Pakistan was forcibly made to leave his native village and to accompany the intruders to an area, which is known as POK (Pak Occupied Kashmir) leaving behind all other family members of the petitioner. The petitioner tried his best to come back to his native village but all his requests fell into the deaf years of the authorities of POK. The petitioner now able to return on an Entry Permit for 15 days, which was extended for a further period of one month and the same, is expiring on September 26, 2006. The petitioner is at the fag end of is life and wants to stay in his native village with his family members. The petitioner never wanted to permanently settle in POK and always wanted to return back to live with his family members at his native village, therefore, the petitioner seeking a direction to the respondents to allow the petitioner to reside in his native village by treating him a bonafide state-subject of the state and a citizen of India.



Justice JP Singh after hearing the counsels appearing for the petitioner issued notice to the respondents returnable within one week.
