Petitioners challenge selection of 76 lecturers

Jammu, Mar 27- In a petition challenging the selection of 76 lecturers 10+2 Botany vide notice February 14, 2009, Justice Mohammed Yaqoob Mir of Jammu and Kashmir High Court Jammu Wing has issued notice to Commissioner/Secretary Higher Education and other state respondents returnable within three weeks and ordered that since the number of respondents is large and for avoiding in connivance publication of service is permitted.
Court, after hearing Advocate Anil Sethi appearing for the petitioners, ordered that selection/appointment of the private respondents shall be subject to the outcome of the petition.
Petitioner Dr. Neeti Chibber and Ors filed a petition seeking quashment of select list issued on February 14, 2009 by the PSC for the post of lecturer 10+2 (Botany) in response to notification PSC dated September 10, 2003, September 20, 2005 and October 13, 2006 in so far as the selection of the 76 respondents for the post of lecturer in Botany. The petitioners have also sought direction to PSC to disclose the criteria adopted by making the selection and further to make available information solicited from it by the petitioners vide different applications moved under the Right to Information Act. Petitioners further seeking direction to respondents to declare as select the petitioners for the post of lecturer 10+2 Botany and to give them all consequential benefits of such selection.
In the petition it has been submitted that the petitioners possess the post-graduate degrees and PhD as well as in the concerned subject and all the petitioners are highly qualified apart from being so qualified they have also passed State Level Eligibility Test and also National Level Eligibility Test.
During the Course of arguments Advocate Anil Sethi alleged that in the present case the notification issued by the by PSC, the mark allotted for interview, academic qualification as also for higher qualification gives sufficient space to the PSC from making maneuver and to favour unqualified and undeserving candidates, granting of excessive marks in the interview as resulted in arbitrary process of selection. He further submitted that as the petitioners prayed that information sought for them under Right of Information Act may be provided to them and PSC be directed to produce the same for just disposal of the matter.
