| HC directs Registry to place petition against fake ST certificates before CJ | | | Early Times Report Jammu, Mar 30-On a petition filed in the larger interest of public against procuring fake schedule tribe certificates, Jusice YP Nargotra of J&K High Court Jammu Wing after hearing Advocate Shah Mohammed Choudhary appearing for the petitioner, today directed Registry to place this petition before the Chief Justice for appropriative orders. The petition filed by Mohammed Anwar Choudhary, a non official member of Advisory Board for the Development of Gujjars and Bakerwals, seeks direction to the State of J&K through Chief Secretary, Principal Secretary GAD and Principal Secretary Social Welfare to constitute scrutiny committee to scrutinize social status certificates issued in the state of J&K from 1991 onwards particularly scheduled tribes certificates and also seeking direction to constitute District Level Scrutiny Committee as per the directions/ guidelines framed by the Apex Court and further seeking quashment of sections 13, 14, 15, 16, 17, 18 of chapter V of Reservation Act 2006 and Rules 18, 19, 20, 21 of Part V of Reservation Rules 2005 issued by SRO 294 dated October 21, 2005 issued by the Social Welfare Department, being ultra virus to the constitution and contrary to Apex Court judgment, and also seeking direction to the respondent state to follow the guidelines laid down by the Supreme Court. In the petition it has been alleged that grant of ST status by the Union Government had filled the hearts of the Gujjar and Bakerwal Communities with the hope that the night of their discontent and despair would soon come to an end and a new day of rational hopes just aspiration was about to down. But all their hopes have been dashed to the ground that the unscrupulous and dishonest elements started procuring fake scheduled tribes certificate by fraudulent means and obtained the benefits of reservation in the service and educational/ professional institutes including medical engineering and agricultural colleges and also in economic establishments. Hundreds of those, who are already entrenched in the corridors of powers and having close connections with the ruling class, have obtained fraudulent certificates by under hand means. The immediate fall out is that thousands and thousands of deserving Gujjars and Bakerwals candidates have been deprived of their due shares in the vital services, educational sectors and economic institutions. Large scale fakes ST certificates have been issued by the Revenue Authorities or have been flatulently obtained by the spurious and unscrupulous elements particularly in Kashmir valley during militancy days in connivance with revenue authorities and prayed for issuance of directions to the respondents to constitute scrutiny committee to scrutinize social status certificates issued in the State of J&K from 1991 onwards.
