| DB starts hearing in two PILs on delimitation of Assembly seats | | | Early Times Report Jammu, Mar 30- A Division Bench of J&K High Court Jammu Wing, comprising Chief Justice Barin Ghosh and Justice Mansoor Ahmed Mir, today started hearing in two Public Interest Litigations challenging the constitutional amendment whereby delimitation of Assembly seats has been suspended till 2026. Earlier, Bhim Singh chairman JKNPP had argued on the PIL filed by his party whereas Senior Advocate and former Advocate General UK Jalali also argued. Advocate SH Shah Ashrafi appeared for the PIL filed by Sheikh Abdur Rehman State President Samajwadi Party and Ex-MP. In both the PILs identical constitutional 29th amendment was challenged whereby delimitation of Assembly seats remained suspended till 2026 Advocate General MI Qadiri today started his arguments whereas former Advocate General and Senior Advocate DC Raina who also appeared in these PILs argued today. Advocate BS Slathia, former Additional Advocate General and ex-BAJ President moved an application seeking permission to allow him to place on record the undisputed factual information which shall render assistance to the Court. It is worthwhile to mention here that application has been filed in the State High Court Srinagar wing for transfer of the PILs at Srinagar Wing. In the PIL it has been prayed for quashment of proviso-II to sub-section 3 of section 47 of the constitution of J&K State, inserted by virtue of constitution of J&K (29th Amendment) Act of 2002 providing therein that it shall be necessary to readjust the total number of seats in the State Legislative Assembly till the year 2026, indirectly debarring the Constitution of Delimitation Commission for readjustment of Seats in the State Legislative Assembly for around three decades and also seeking direction to the respondent State to constitute Delimitation Commission as contemplated under sub-section 3of section 47 of the Constitution and Section 3 and 4 of Representation of Peoples Act 1957.
