| HC upholds PIT NDPSA | | | Early Times Report
JAMMU, Nov 19: Justice MA Chowdhary of Jammu & Kashmir and Ladakh High Court upheld the detention under PIT NDPSA of Manpreet Singh @ Sartaj.
Justice MA Chwodhary while dismissing the petition filed by Manpreet Singh @ Sartaj seeking quashment of Detention Order No. PITNDPS 66 of 2023 dated 09.12.2023 (in short the, "impugned detention order1') passed by the respondent No. 2-Divisonal Commissioner, Jammu (hereinafter called as the, "detaining authority'9) under Section 3 of the Prevention of Illicit Traffic in Narcotic Drugs and Psychotropic Substances Act, 1988 (hereinafter referred to as the "Act of 1988) read with SRO 247 dated 27.07.1988, with further prayer to order release of the petitioner from the custody, observed that the contention, on behalf of the detenue/petitioner that his representation was not considered, is not factually correct as is borne out of the detention record. No other ground was urged. As such, detention order cannot be said to have invalidated on this count of representation. As a result, petition is found to be devoid of any merit and is liable to be dismissed. —JNF |
