POCSO court awards 20 years imprisonment for raping 9 years old | | | Early Times Report JAMMU, Jan 27: Presiding Officer Fast Track Court POCSO Srinagar Aarti Mohan awarded 20 years imprisonment to Fazil Saleem Bhat S/O Mohammad Saleem Bhat R/O Batwara, Srinagar for raping with 9 years old minor. The facts of the case that are that on 09.03.2020 complainant father of victim presented a written complaint before Police StationRam Munshi Bagh wherein he stated that his daughter,aged around 09 years, went to buy biscuits from the shop of accused. The accused took her to 2nd floor and committed rape upon her.On this information FIR no. 20/2020 was registered in police station Ram Munshi Bagh under section 5/6 of POCSO Act. After completion of investigation the charge under section 5 was found to be not established and chargesheet was filed against the accused under section 7/8 of POCSO Act. Presiding Officer Fast Track Court POCSO Srinagar Aarti Mohan after hearing PP Noor ul Sajad for the UT, observed that this court cannot also overlook the fact that the POCSO Act was enacted since a strong need was felt to take stringent measures to deter the rising trend of child sex abuse in the world and specially in this country. The child sexual abuse is a serious problem and a large number of cases have been emerged where the children are being subjected to physical, emotional and the most heinous of all, sexual abuse. The crime against the children by way of sexual harassment not only affects the child's physical and psychological health but also has a devastating effect on the society as well the family of the victim and ordered that the convict is awarded simple imprisonment of twenty years (20 years) along with a fine of Rs. 10,000 under section 4 of POCSO Act. —JNF |
