Court awards 10 years RI and fine Rs 1 lac in narco smuggling case

JAMMU, Feb 25: Principal Sessions Judge Samba RN Wattal today awarded ten years rigorous imprisonment and fine Rs 1 lac to Prithpal Singh a Narco Smuggler. The brief facts of the case are that Insp. Rakesh Bamba of police station Vijaypur alongwith Police personnel Cts. Ajay Singh & Lal Hussain, on 1610 hrs on 25.03.2019, left in Govt. Vehicle driven by SPO Darshan Singh to Raya Morh NHW for checking, during checking vehicles coming from Jammu to Samba were checked, at about 1555 hrs, one truck bearing registration No. JK02T-2581 on way from Jammu to Samba was stopped, on checking the truck 3 plastic bags were found in the vehicle containing poppy straw and same were downloaded, weighed and were found to be 50/55 kgs, the truck driver Prithpaul Singh who is also owner of the vehicle was asked about carrying the huge quantity of poppy straw in his vehicle, he could not gave satisfactory reply, prima faciely offence u/s 8/15/60 NDPS Act were alleged to have been committed by the driver/owner of the vehicle. Principal Sessions Judge Samba RN Wattal after hearing Ajay Kumar PP for the UT whereas Adv Ganesh Sharma for the accused observed that 5. The accused is involved in sale, purchase and transportation of commercial quantity of contraband (poppy straw) and same has recovered from him from his vehicle. The use of drugs is a menace in the society. Any leniency shown to drug peddlers /smugglers may affect the society and Courts are required to be sensitive to societal demands that those who are involved in sale and purchase of drugs do not roam ascot free. They are required to be dealt with iron hands and sentenced accordingly, so that same is deterrent in society and those who indulge in sale and purchase of drugs shall think hundred times before resorting to such trade. At the same time the Court has also take a note of the accused and his family. The family of convict gets adversely affected. Keeping in view the facts and circumstances of the case, accused is convicted and sentenced to undergo rigorous imprisonment of 10 years and a fine of Rs.1.00 lacs U/S 8 read with section 15 of NDPS Act and in default of payment of fine he shall undergo further rigorous imprisonment of one year.
