| Check out is there any SAC today ? | | | Early Times Report Srinagar, April 14: State Accountability Commission, set up in 2002-03 with a purpose of bringing accountability in the entire government system, will go member less as its lone member attains superannuation on Wednesday.
Meanwhile, Press Bureau of India has learned that the government has approached Election Commission of India for its permission to consider names for filling the position of chairperson and its two members.
On last Monday, sources said, Chief Minister Omar Abdullah, who is also the head of the committee formed by the Law department to make appointments in the body, had convened a meeting of the committee members which include Chief Justice of High Court, Law Minister, Abdul Rahim Rather and leader of the largest opposition party, People Democratic Party president Mehbooba Mufti.
The meeting was scheduled to consider the names for the posts of chairperson and two members of the body after the recommendation by the central government.
However, sources said, the meeting could not be held owing to the absence of Mehbooba Mufti.
Sources told that Mehbooba Mufti had dispatched a letter stating therein that due to Model Code of Conduct, the names for the Chairperson or members could not be discussed and suggested that the meeting should be held after parliamentary elections.
The other members, sources said, decided to approach Election Commission of India to know whether its clarification was necessary even for the consideration of the names for appointment of SAC bench.
The government has been fixed the next meeting of the committee on April 23, sources added.
The state accountability commission was set up in 2002-03 with sole purpose of bringing accountability in the entire government system.The body is however ‘defunct’ for the past nearly nine month months after its last chairman Justice JL Raina and one of its two members attained superannuation as per the Jammu and Kashmir Accountability Commission Act, 2002.
According to the Act, the Commission is comprised of a Chairperson and two members, who shall hold office for a term of three years or until they attain the age of 70 years, whichever is earlier. The Act also says that a vacancy occurring in the institution of State Accountability Commission shall be filled in as soon as possible.
Sources said that since the retirement of the chairperson and one member in June last year, the commission has received only two complaints in February contrary to 20 to 25 complaints received per month before June last year.
Sources further said that more than 250 complaints are lying with the commission to be deposed and has been stalled primarily due to lack of staff in the commission. As per the purview of the Act, the member of the commission cannot depose the case for presence of the chairperson is mandatory for any action. As a fact, the sources said, the cases registered with the body only get fresh dates, resulting into the piling of the cases.
