| GAD order on revoking JE’s promotion stayed | | | Early Times Report Jammu, Apr 15- Justice Nisar Ahmed Kakru of Jammu and Kashmir High Court Jammu Wing today issued notice to the respondents and stayed the operation of the impugned order of March 26, 2009 in so far it related to the petitioner subject to the objections of the other side. In the petition it has been submitted that the petitioner has been working in the Rural Development Department as Work Supervisor/ Draftsman and during his service he underwent Diploma Courses from Vinayaka Mission’s Research Foundation, Tamilnadua Deemed University as notified by the UGC through Distance Education. The State respondents in order to ascertain the validity and legality of the courses as also Vinayaka Mission’s Research Foundation referred the matter to the State Vigilance Organization. SVO conducted enquiry in the matter and approached UGC New-Delhi. The UGC in response to the queries, put across by the SVO informed it that Vinayaka Mission’s Research Foundation Tamilnadu has been declared as “Deemed University” vide Notification of March 1, 2001. It has been further mentioned that the UGC has not approved any course run by the “Deemed University” under Distance mode and the courses under Distance mode by “Deemed Universities” have to be approved by UGC-AICTE-DEC Joint Committee. It has been stated in the said communication that the UGC has asked the “Deemed University” to approach Joint Committee through Distance Education Council for approval of the courses run under Distance Mode. After the report of SVO, GAD issued office memo dated March 9, 2009 by virtue of which PWD of the State Government was advised to withdraw the Government order dated June 25, 2008 and Government order dated March 22, 2007 revoking the promotion of the petitioner, which was challenged by the petitioner on various ground and seeking quashment of said order.
