Labour Commissioner J&K Issues Notices to Inactive Trade Unions for Non-Compliance

JAMMU, Mar 20: In a significant move to streamline trade union activities in Jammu & Kashmir, the Labour Commissioner & Registrar Trade Unions, J&K, Charandeep Singh, JKAS, has issued show cause notices to trade unions that have failed to comply with mandatory legal requirements, including the submission of Annual Returns.
This action follows a first-of-its-kind interactive meeting held at Shram Bhawan, Jammu, where the Labour Commissioner engaged with trade union representatives from the Jammu division. During the meeting, he emphasized the importance of adherence to legal obligations under the Trade Unions Act, 1926, particularly the timely filing of Annual Returns under Section 28 of the Act.
The Labour Commissioner made it clear that unions failing to fulfill their statutory duties risk cancellation of their registration. He urged trade unions to maintain proper records, abide by their by-laws, protect the rights of their members, and conduct elections in accordance with the prescribed guidelines.
The show cause notices have been issued to inactive trade unions that have not submitted their Annual Returns for multiple years. These unions have been directed to provide an explanation within one month; failure to do so will result in the cancellation of their registration.
Trade unions are required to submit their pending Annual Returns through the Single Window JK platform to ensure compliance with the Trade Unions Act, 1926, particularly Section 28, which mandates the timely filing of Annual Returns. Trade unions can visit the Single Window JK portal and follow the prescribed steps for online submission.
The Labour Department reaffirmed its commitment to ensuring transparency, accountability, and the efficient functioning of trade unions in Jammu & Kashmir. Trade unions have been urged to take immediate corrective measures to avoid legal repercussions.
