| CJM Kargil acquits three accused as prosecution fails to prove charges | | | EARLY TIMES REPORT Kargil, Apr 23- Chief Judicial Magistrate, Kargil R K Abrol today acquitted Syed Yaseen, Syed Murtaza and Syed Mehdi from the commission of offence u/s 332,34 RPC as the prosecution failed to make out it a case and prove their guilt. According to the prosecution story the accused persons traveling in Alto Car No JK07-6168 from Minjoo to Baroo on August 10, 2006 when signaled to stop by the Police constable Fayaz Ahmed became furious and after getting down from the car attacked upon him and tore off his uniform. Upon this report a FIR NO; 86/06 was registered and accused were challaned in the court of the law on September 5, 2006. CJM after hearing the defence counsel Mohammed Amin and Prosecuting Officer for the state, Tsering Phunchok observed that the prosecution has totally failed to connect the accused persons with the commission of offence u/s 332, 34 RPC as Court found the evidence full of exaggeration and prosecution story shaky and unreliable. The Court further observed that the evidence was not found trust worthy and the police officials appearing as witnesses could not support and corroborate the complainant’s evidence and accordingly the Court acquits all the three accused from the charges leveled against them.
