JAMMU, June 17: Principal Sessions Judge Ganderbal Abdul Nasir awarded 10 years imprisonment and fine Rs 1 lacs to Ghulam Mohammad Lone in rape case.
The Brief facts of the prosecution case are that on 13-04-2017 the complainant lodged a report before the police station Kangan to the effect that the complainant is an orphan child. The complainant is a resident of Chattergul, Kangan. About 7 months ago, the accused forcibly entered into the house of complainant and committed forcible rape, due to which the complainant has become pregnant. The complainant due to the pressure and being an orphan could not tell the incident to anyone. The complainant has no support and source at all and has no help. Accused is harassing the complainant time and again due to which she could not tell the incident to anyone. On this report, FIR No.27/2017 for offences u/sections 376/447 RPC was lodged.
Principal Sessions Judge Ganderbal Abdul Nasir after hearing both the sides observed that it is proved beyond all reasonable doubts that the accused has committed sexual intercourse with the accused on the false promise of marriage without having intention to marry the victim. Therefore, accused is convicted for the commission of offence u/s 376 RPC.As the guilt of the accused stands proved beyond all reasonable doubts.
Court while considering the circumstances and facts of this case, this Court is of the opinion that the offender has spoiled the life of victim under the promise of marriage, which was turned down by the offender once the victim became pregnant, therefore, the offender deserves no leniency. The offender is sentenced to simple imprisonment for 10 years and a fine of Rs. 1,00000/- (One lakh) for the commission of offence under section 376 Ranbir Penal Code. Copy of this judgment be delivered free of cost to the offender and the offender be sent to judicial custody in Central Jail, Srinagar for undergoing the period of sentence. —JNF
