Chief Judicial Magistrate sentence six month imprisonment in eve teasing case

JAMMU, July 8: Chief Judicial Magistrate Jammu Preet Simran Kour Grover sentence six months imprisonment and fine Rs 10000/- to one Ranjeet Kumar after 12 years trial and investigation in eve-teasing case.
Brief facts of the case are that on 21.06.2013 complainant (Victim) W/o Sanjeev Kumar R/o House no. 346/J Rehari Colony, Jammu came to P/P Sarwal and submitted one application in Hindi. The contents of said application are that one person namely Ranjeet Kumar S/o Sudama Bhagat R/o House no. 304 Rehari Colony has come openly and held her arm and even teased her and told her to flee along with him as he is in love with her and in public kissed her on her neck. Even he used to torture her on phone. When he forcefully held her, her chain got broken in scuffle. The said person tried to forcefully outrage her modesty however she rescued herself from him. She is a married lady due to which she faced difficulty in her life. She further informed that the said person has told her that till he sees her sexy face, he is not satisfied. As such prayed for lodging of case against him as due to the said act she has felt insulted. Further, on her oral submissions she deposed that Ranjeet Kumar S/o Sudama R/o Rehari Colony used to call her and used obscene language and used to say that he likes her and cannot live without her. On the day of incident, she has come to Rehari Colony for some work and around 07:00 pm when she reached in a lane near Baby Caterers then he has forcefully held her arm and kissed her on her neck due to which she felt insulted. During scuffling, her chain also got broken however later on she got it. On the basis of said application, a report no. 22 entered in Roznamcha dated 21.06.2013 was sent to P/S Bakshi Nagar from Police Post Sarwal for lodging of FIR and accordingly FIR No. 86/2013 has been lodged for commission of offence under section 354 RPC.
Chief Judicial Magistrate Jammu Preet Simran Kour Grover after hearing APP Vikram Parihar for the UT, observed that the prosecution has been therefore successful in establishing that accused has outraged the modesty of victim with criminal force. The ingredients of offence punishable under section 354 RPC are squarely met. Therefore, accused is held guilty of the above stated offence and is convicted for the same. Therefore, accused is hereby sentenced to undergo simple imprisonment for six months with a fine of Rs. 10,000/- for commission of offence under section 354 RPC. —JNF
