DB confirms life-imprisonment of accused

Jammu, Apr 30- Confirming the conviction and sentence awarded by Sessions Judge Jammu on September 13, 1997, whereby the appellant Dev Raj son on Sukh Ram was awarded life imprisonment for committing murder of his friend for only Rs, 12000 which had taken from the deceased but not returned despite requests, the Division Bench of J&K High Court Jammu Wing comprising Justice Virender Singh and Justice YP Nargotra today dismissed the criminal appeal filed by the appellant.
The DB, after rescanning the entire evidence on record, observed that it can be comfortably said that all the main planks of circumstantial evidence are individually established, the cumulative effects of which is that there is no escape at all from the conclusion that within all human probabilities, the crime of killing Rashpal Chand has been committed by the accused and none else. With this observations DB dismissed the criminal appeal filed by appellant and confirmed the life-imprisonment awarded by the Trial Court.
According to the prosecution case the father of deceased lodged a written complaint with P/S Kanachak Jammu alleging therein that prior to the occurrence the accused Dev Raj had taken Rs 12000 from deceased Rashpal Chand and despite repeated request for return of said amount, the accused had been lingering on the matter. On November 1, 1995 deceased had gone to village Jhafey Chak for collecting the amount but he did not return. It was alleged that Rashpal Chand was shot dead by the accused and his dead body was lying in the house of the accused. The Kanachak police took possession of the dead-body from the house of the accused and accused was arrested on November 9, 1995. On the disclosure of the accused a revolver of 12 bore was recovered from the compound of accused. After completion of the investigation police presented challan in the Court of law, the Sessions Judge Jammu awarded life-imprisonment to the accused along with fine Rs. 5000 which was challenged by the accused in an appeal filed through Advocate OP Sharma with Advocate Barut Gupta whereas Additional Advocate General PC Sharma appeared for the state.
