Petitioners be promoted as Deputy Conservator of forest: CAT

JAMMU, July 21: A petition came to be filed by three individuals seeking directions to promote them as Deputy Conservator of Forest retrospectively with all the consequential benefits. Adv.Aditya Sharma appeared on behalf of the Applicants submitted that the case of the Petitioner is securely covered by the Clause ll of the J&K Forest Recruitment Rules, wherein it has been categorically provided that those who had served as Rangers not less than 16 years are to be promoted from in service Assistant Conservator of Forest.
It was further submitted that the applicants were due to be promoted as Deputy Conservator of Forest with effect from 01.12.2008, 01.06.2008 and 01.04.2008 respectively but the respondents have deliberately and intentionally did not promoted the petitioners rather rejected their case on the ground that they must serve 6 Years as AIF then only could have been considered.
A Bench of Central Administrative Tribunal Comprising Rajinder Singh Dogra and Ram Mohan Johri after hearing the counsel for the Petitioner Adv Aditya Sharma and after going through the record held that it transpired that when the applicants were retired they were Assistant Conservatory of Forest and they were entitled to the next higher post of deputy conservator of Forest as per clause ll of the j&k forest recruitment rules.
Earlier petitioners approached the High court and the court directed the respondent to consider the case of the petitioner , but respondents rejected the same on the ground that they had not rendered 6 years as AIF thus cannot be considered and ignored the clause ll of the recruitment rules.
Central administrative tribunal allowed the petition of the applicants and directed the respondent to promote the applicants to eh post of Deputy Conservator of forest w.e.f 01.11.2008,01.06.2008 and 01.04.2008 respectively with all the consequential benefits including the pensionary benefits and the entire exercise must be completed by the respondents within a period of three months from the date of service of this order. —JNF
