Two real brothers facing trial in murder case get life imprisonment

Jammu, May 01-The 2nd Additional Sessions Judge Jammu Vinod Chatterji Koul today awarded life-imprisonment and fine of Rs 5000 each to accused Vinod Kumar alias Jumbu and Sushil Kumar alias Manka sons of Dev Raj resident of Old Basti Bahu-Fort Jammu who were facing trial in a murder case of Ravinder Kumar son of Nand Lal resident of Nai Basti whose dead-body was found near Press Morh Bahu-Fort on May 12, 2006.
After hearing Additional Public Prosecutor Ravinder Sharma appearing for the state and Advocate Kuldeep Raj Gupta for the accused persons and also going through the statements of witnesses, the 2nd Additional Sessions Judge, observed that from the facts and circumstances established by the prosecution it is proved beyond doubt that the accused had taken the deceased along with them on fateful evening on the false pretext of some work as the contention of the accused was to liquidate him on account of their hostility towards the deceased and his family. They accordingly put him to death and thereafter threw the dead-body at Press Morh Bagh-e-Bahu and defaced his face. Accordingly accused are held guilty of offences punishable u/s 302/34 RPC and they are convicted for the said offences. On the quantum of sentence, Court, after considering the young age of accused persons, awarded life-imprisonment and a fine of Rs. 5000 to each for commission of offence u/s 302 RPC.
According to the prosecution case on May 12, 2006 the Assistant Sub- Inspector Darshan Kumar on patrolling found a dead body of a male lying near Saryara Sabha Press Morh, identified that of Ravinder Kumar son of Nand Lal. The case which was transferred to Crime Branch for investigation found that accused and deceased had an old enmity on the basis of which they had a fight in the year 1993. Both the accused and the deceased had to attend a marriage ceremony of son of Harbans Lal. The accused Vinod took the deceased from his house with him for attending the marriage, one Bodh Raj brother-in-law of the deceased and all the three went to a Dhaba where they consumed liquor. Bodh Raj left the place and accused Vinod Kumar and deceased proceeded to attend the marriage. Deceased was having one packet of liquor which was brought by accused Vinod Kumar and they again consumed liquor, under the influence of liquor deceased fell down and in order to take advantage of this accused called his brother Sushil Kumar and both of them took the deceased from the spot to the place of occurrence where they pressed the neck and legs of the deceased till he was dead. In order to destroy his identity they attacked on the face of deceased with stone and thereafter both fled from the spot and again went to attend the marriage. A case u/s 302/34 RPC committed by the accused persons as per the investigation conducted by the Investigating Officer Kanya Lal of Crime Branch. After completion of the investigation challan was presented in the Court of law JNF.
