Special judge NDPS denied bail in NDPSA case

Udhampur, July 24: Special Judge under NDPS act Sessions Judge Udhampur Virender Singh Bahou rejected bail application of. Dhani Ram S/o Fishar R/o Drabali Tehsil Salooni District Chamba ( Himachal Pradesh ) , who was arrested under NDPS Act. On 26.04. 2025 by police team of police station Chenani when he along with other two persons was on way from udhampur and during checking was found in possession of charas . The accused was found involved in illegal sale and purchase (smuggling) of narcotic drugs for earning monetary gains .
After hearing the Ld. counsels for the applicant/ accused A.P.P for the UT of J&K, and perusal of the contents of the application, police report, objections as well as CD file.
Order said that for the aforesaid reasons and nature of the evidence collected by IO and law applicable to the facts of this case,accused / applicant is involved in conspiracy involving possession of commercial quantity of contraband for sale.
Thus, the rigor of Section 37 of the NDPS Act is applicable to the present case. In the aforesaid background, this does not appear to be a case where it could be reasonably believed that the accused / applicant is not guilty of the alleged offence.
Judge in his order said that the aforesaid reasons the bail application is bereft of any merit and thus, rejected. Nothing stated in the disposal of this application shall be construed as expression of opinion on the merits of the case.
