Early Times Report JAMMU, Aug 7: Additional Sessions Judge Udhampur Kamlesh Pandita dismissed the bail application filed by three Myanmar nationals detained as part of a district-level drive against illegal immigrants. The applicants-Mohammad Jubair, Najim Ullah, and Haroom Mohammed, all residents of Myanmar currently residing at Kiryani Talab in Jammu-had sought bail on the ground that they were not involved in any cognizable offence and were registered refugees holding UNHCR identity cards. The State, represented by Additional Public Prosecutor Hemanshu Prakash, submitted that the applicants were among eight individuals identified as illegal immigrants in Udhampur by a Special Task Force constituted under Home Department Order No. 299-Home dated June 5, 2025. The STF was tasked with the identification and deportation of foreign nationals residing unlawfully in the district. According to the police report, the applicants have been shifted to the Holding Centre in Hiranagar, District Kathua, in view of their scheduled deportation, following due legal and procedural processes. The court, while considering the submissions, observed that the applicants had entered and were residing in Indian territory without valid documents, and posed a potential threat to national security and public order, particularly in the prevailing geopolitical context. Citing ongoing proceedings before the Supreme Court in Mohammad Saleemullah vs Union of India concerning the deportation of illegal immigrants, Judge Kamlesh Pandit ruled that no bail could be granted under the circumstances. "In the interest of national security and public order, restraint on the movement of the applicants is warranted," the court said. The application was accordingly dismissed, and the case consigned to the record. (JNF) |
