HC orders crackdown on illegal banquets halls

Jammu, May 07- In a Public Interest Litigation (PIL) the Division Bench of J&K High Court Jammu Wing comprising Justice Nirmal Singh and Justice Sunil Hali today ordered that banquets halls which are running within municipal limits, Jammu, without proper permission from the Municipal Corporation Jammu, shall remain closed. However those banquet halls which have obtained proper permission shall be allowed to run subject to the condition that the music systems, if any, shall be operated from 10:00 AM to 10:00 PM only, the Court ordered.
This signification order has been passed by the Division Bench in a petition filed by Puran Chand of Pacca Danga Jammu and Bansi Lal of Shakti Nagar Jammu opposite M/S Jagat Resort near AG Office Jammu. Advocates SK Anand, AK Kapoor and DS Thakur appearing for the petitioners submitted that some banquet halls are being run without proper permission from the municipal authorities. It is stated that nuisance is being created by such like banquet halls which are operating illegally and further stated that even some banquet halls are operating in residential areas and the noise pollution is also being created by the said banquet halls as the music system on kept for whole the nights.
Division Bench, after hearing Advocates PN Raina, SS Nanda, Abhinav Sharma and Additional Advocate General Seema Shekhar appearing for the respondents and taking into consideration the aspects of the matter, directed the municipal corporation Jammu, to file a status report as to how many banquet halls are running in the municipal limit of Jammu, without proper permission, as to how many banquet halls have got the parking facilities, as to how many banquet halls have been opened in the residential areas and whether any permission has been obtained in this regard from the authority concerned. This status report be filed on or before next date of hearing. Till then the banquet halls which are running without proper permission shall remain closed. DB directed the registry to serve a copy of this order upon the SSP Jammu, it would be appropriate if the said officer holds regular meetings with the concerned authorities of municipal corporation Jammu and constitute a team which would visit all the banquet halls operating within the municipal limit Jammu and see to it that the directions contained in this order are implemented in letter and spirit and directed registry to list this petition in the week commencing from May 18, 2009.
