| Defamation case against Pioneer transferred to Jammu | | | Early Times Report Jammu, May 08- Justice Muzaffar Hussain Attar of Jammu and Kashmir High Court Jammu Wing has transferred defamation case filed by Ghulam Nabi Shaida Editor of a Srinagar based newspaper namely Wadi Ki Awaz against Chandan Mitra Editor-in-Chief and Managing Director the Pioneer New Delhi and also sitting member of Parliament of Rajya Sabha from Srinagar Court to Jammu court. After hearing Advocate Inderjeet Gupta appearing for the petitioners and Advocate HC Jalmeria appearing for the respondents, Justice Hussain allowed the petition and criminal complaint titled Ghulam Nabi Shaida Vs Chandan Mitra and Ors pending in the Court of 2nd Additional Munsiff Srinagar and ordered that the same be transferred to the Court of Judicial Magistrate 2nd Additional Munsiff Jammu with the direction that the petitioners will pay an amount of Rs 5000 to the complainant and each witness of the complainant on every date of hearing. In the criminal transfer application filed by petitioners though Advocate Inderjeet Gupta it has been submitted that in September 22, 2005 edition of Pioneer an article was published which was written by Anil Bhat. The complainant Ghulam Nabi Shaida through his Advocate Mian Abdul Qayoom sent a notice to petitioners stating that defamatory material has been published in the Daily Pioneer against the respondent which has caused great deal of injury and has damaged his personal deputation. The notice further called upon the petitioners to pay Rs 4 crore as damages within one month or face legal action in the court of competent jurisdiction. A case u/s 500-b/502 of RPC was filed before the 2nd Additional Munsiff Judicial Magistrate Srinagar. The 2nd Additional Munsiff Srinagar issued warrants for appearance of the petitioners on October 17, 2005. JNF
