Two Udhampur men sentenced to life for 2015 double murder over land dispute | | | Early Times Report JAMMU, Oct 14: The Principal Sessions Judge Udhampur, Virender Singh Bhou, on Tuesday sentenced two men, Kaka Ram of Sadota and Khem Raj of Basnote, to rigorous imprisonment for life in connection with the sensational 2015 double murder case that had rocked Panchari tehsil. The convicts were found guilty of murdering Siraj Din and his son Binya in June 2015 following a bitter land dispute. According to the prosecution, the victims were attacked inside their house with axes after the accused trespassed with the common intention of eliminating them to settle scores over money and land ownership. The FIR was registered at Panchari Police Station after complainant Abdul Karim, brother of deceased Siraj Din, reported that his brother had purchased land from Kaka Ram three decades ago and was living there with his family. On June 23, 2015, both father and son were discovered brutally killed with deep injuries on their head and neck. Police recovered blood-stained soil, weapons, and clothes, and witnesses testified to the recovery of axes used in the killings. Public Prosecutors Himanshu Parkash and Vinay Sharma pressed for maximum punishment, calling the crime brutal and motivated by greed. Appearing for the convicts, Advocate Ashutosh Gupta argued for leniency, citing their old age, family responsibilities, and lack of prior criminal record. The Court held that the murders were the result of "dishonest intention and greed for land" on the part of the convicts. While noting the heinousness of the crime, the judge ruled that it did not fall under the "rarest of rare" category warranting the death penalty. Instead, the convicts were sentenced to life imprisonment under Section 302 RPC with a fine of ?10,000 each, and 10 years of rigorous imprisonment under Section 449 RPC with a fine of ?5,000 each. The sentences will run concurrently. In case of default in payment, further imprisonment will follow. The Court ordered that the fine, if realized, be paid to the legal heirs of the deceased and recommended that the J&K State Legal Services Authority extend statutory compensation to the bereaved family. The judgment and sentence have been referred to the High Court of Jammu & Kashmir and Ladakh for confirmation. The convicts have also been informed of their right to appeal within 14 days. (JNF) |
