| DELIMITATION | | Bhim to present case today | | Early Times Report Srinagar: Kashmir High Court Bar Association on Thursday completed arguments in opposition to the petition seeking fresh delimitation of assembly constituencies in the state. A Division Bench of High court comprising of Chief Justice, Justice Barin Ghosh and Justice Mansoor Ahmad Mir heard the arguments of KHBA president, Advocate Mian Abdul Qayoom, advocate G A Lone, advocate ST Hussein and noted advocate Zaffar Ahmad Shah. In his arguments, Mian Abdul Qayoom termed the petition as an attempt to draw political mileage in a ‘particular section of a particular region of the state.’ Advocate Qayoom also contented the assertion in the petition that suspending delimitation till 2026 was against democracy. People in Jammu and Kashmir, he said, demand their right of self determination. The people never enjoyed democracy in its true sense, he said in his arguments. The writ petition was filed by the Jammu and Kashmir National Panthers Party seeking direction of the High Court to the state government to constitute a Delimitation Commission to delimit the Assembly constituency regarding extent and boundaries. The petition was filed in the court by the president of JKNPP, Professor Bhim Singh after government turned down a bill seeking increase in the number of assembly segments. On March 12 this year, the High Court heard the case for the first time and in his arguments, Bhim Singh says that Jammu has a larger geographical area than Kashmir and hence it should have more seats. He had submitted that the refusal by the state to appoint a delimitation commission amounts to discrimination against the people of Jammu and it destroys the basic structure of the constitution. Meanwhile, the division bench would hear the petitioner tomorrow for his arguments in response to objections by the KHBA.
