JKLF Chief and Others appeared in TADA Court in four cases

Jammu, September, 23:- JKLF Chief Mohd Yaseen Malik and others today appeared in the Court of TADA/POTA in four cases including kidnapping of Dr. Rubia Syed d/o the then Union Home Minister and Former Chief Minister of J&K State Mufti Mohd Syed.



Presiding Officer TADA/POTA Court Jammu Wani ND today after hearing Senior Advocate ZA Shah with Advocate Yogesh Bakshi and Vipin Gandotra and Special Public Prosecutors appearing for the CBI has adjourned the cases on the request of Sr. Advocate Shah, who sought time for the arguments on the plea that since holy month of Ramzan is commencing from September 25, 2006 and it is not possible for him to attend the Court during this month because he as to observe the fast, upon this Wani ND said that prayer of the advocate is genuine and adjourned the cases.



In the kidnapping case of Dr. Rubia Syed, according to CBI case that in the month of December, 1989, the accused persons namely Mod Yaseen Malik, Showkat Ahmed Bakshi, Ali Mod Mir, Manzoor Ahmed Sofi, Javid Mir alias Nalka, Mohd Rafiq alias Nana ji, Mehraj-ud-Din Sheikh, Mohd Yaoob Pandit, Mohd Iqbal Gandroo, Wajahat Wazir Qureshi and Mohd Zaman Mir, who were present today in the Court allegedly have kidnapped Dr. Rubia Syed while she was going Medical College Hospital in a matador and for the release of Dr. Rubia Syed, the state Govt was compelled to release five hard-core militants of JKLF. After the demand of the kidnappers was fulfilled, Dr. Rubia Syed was released by the Kidnappers.



In another case which was investigated by the CBI in which five Air-Force Officials were killed at Batmaloo Srinagar on January, 1990 in which all the accused were present, the Senior Public Prosecutor for CBI has argued on the stage of framing charge and concluded his argument by stating that Charge against the accused for the commission of Offence u/s 302/120-B/307 RPC ¾ TADA r/w section 7/27 Arms Act prima-facie proved against the accused persons.



In another case in which besides Yaseen Malik, Manzoor Ahmed Sofi and farooq Ahmed alias Bitta Karate (who was brought in custody from Kathua Jail), which was also adjourned.



In another case of One Lac US Dollar, which was resgietred by the Kud Police on March 23, 2002 in which JLF Supremo was arrested by the police from Srinagar while he was addressing a press-conference and lateron investigation was transferred to Crime Branch Jammu, the Crime Branch after the completion of the investigation has presented Challan in the Court of POTA against JKLF Supremo Mohd Yaseen Malik, Mustaq Ahmed Dar and Shamima alias Shazia alias Bitti, all the accused are on bail in this case. Today Yaseen Mailk and Mustaq Ahmed Dar were present in the Court whereas application for exemption of Shamima presented by the counsel, Court granted exemption on the surety of counsel for today only.



It is worthwhile to mention here that all the cases are pending before the Court for framing charges whereas Kidnapping of Dr. Rubia Syed and Killing of Air-Force personals are pending for last more than 15 years at the stage of framing charge.
