| Charged of his wife’s muder, husband acquitted | | | EARLY TIMES REPORT Jammu, May19- Following failure of the prosecution to prove case against the accused the Court today acquitted Sandoor Singh of village Sarore Bishnah who was allegedly involved in committing murder of his wife. Principal Sessions Judge Jammu SS Sarangal, after hearing Public Prosecutor EA Tak for the state and Advocate Prince Khanna appearing for the accused, observed that Surinder Singh, who is the star witness of the prosecution, has stated in his statement that his father, the accused, had come to police station Bishnah after committing the murder of his mother and made a statement before the police that he has murdered his wife whereas the Investigating Officer of the case Inspector Bodh Raj SHO P/S Bishnah has categorically stated in his statement that the FIR in the case was lodged on July 17, 2004 whereas the accused was arrested on July 18, 2004, so making the confessional statement by the accused before the police on the day of occurrence July 17, 2004 does not arise. The contention of Surinder Singh that the accused had gone to the police station on July 17, 2004 after committing the crime and made there a confessional statement is wrong, it is story of the prosecution that accused made a confessional statement on July 21, 2004 after five days of the occurrence and two witnesses of the disclosure statement namely Onkar Singh and Jodh Singh but both these witnesses have not been produced by the prosecution which is fatal for the case of the prosecution as there is no independent witness to the disclosure statement of the accused. With these observations, Court acquitted the accused Sandoor Singh of the charges leveled against him as the prosecution has not been able to prove the case against the accused beyond reasonable doubt and as such the benefit of doubt is given to the accused. According to the police case on July 17, 2004 Surinder Singh, complainant, lodged a verbal report with police station Bishnah alleging that the relations of his father and mother were not cordial for the last more than 3-4 years and his father oftently used to beat his mother. On July 16, 2004 his father, the accused, also beat up his mother and on July 17, 2004 at about 11:30 AM his parents went to the field for work and at about 2:00 PM the complainant also went in the field, when he reached near the field he heard noise “Mar Diya Bacho” and after hearing this noise he reached on spot and saw that his father was beating his mother and his mother was made laid on the ground. On seeing the complainant the accused ran away from the spot. Complainant found his mother to be dead. On this repot a case u/s 302 RPC was registered against the accused by the Bishnah Police, after completion of the investigation police presented challan in the Court of law. In the statement Surinder Singh son of the accused and deceased said that accused was habitual of taking liquor and gambling and had sold the ornaments of his mother and now accused wanted to sell the land also, her mother used to prevent him from selling the land. After killing the mother his father had himself gone to police station Bishnah where he told the whole story to the police. JNF
