| 2003 Bani blast accused acquitted | | | EARLY TIMES REPORT Jammu, May 19- In a much publicized blast case in June 2003 in Bani area of Kathua district in which one constable Ashok Kumar was killed on spot and several others sustained injuries, the 3rd Additional Sessions Judge Jammu, acquitted Raj Din from the charges of criminal conspiracy with other accused Mohammed Ashraf and Abbas Ali against whom proceedings u/s 512 Cr PC were initiated to cause murder of civilian population and to spread terrorism, create unrest in the society planted bomb which was exploded in which one constable died on spot and other persons were injured. While acquitting the accused, the Court observed that the accused was under trial from 2005 and prosecution has also been given numerous opportunities to adduce evidence and vide order dated May 2, 2009 the prosecution was given last and final opportunity to adduce evidence and calendar was fixed. Court further observed that perusal of the testimonies of the witnesses examined by the prosecution shows that none of the witness have connected the accused with the commission of offence with which he is charged. There is no evidence on record to show that accused Raj Din had planted bomb which was later on blasted by him where in some person were injured and security personnel killed. There is nothing on record to prove that the accused has indulged in activity of pre-judicial to the security of the state are that he was connected with terrorism activities to murder civilian and security personnel and de-stabilize the country as such the accused are acquitted from the charges, the Court ordered.
