| Court hearing begins as JMC files status report on 89 banquet halls | | | Early Times Report Jammu, May 21- After hearing battery of lawyers appearing for the much publicized seizure and closure of 89 banquet halls and hotels, the Division Bench of Jammu and Kashmir High Court Jammu comprising Chief Justice Barin Ghosh and Justice Muzaffar Hussain adjourned the case till tomorrow. On May 7, the Division Bench, after hearing this public interest litigation had ordered that banquets halls which are running within municipal limits of Jammu, without proper permission from the Municipal Corporation Jammu, shall remain closed. Those banquet halls which have obtained proper permission shall be allowed to run subject to the condition that the music systems, if any, shall be operated from 10:00 AM to 10:00 PM only. In the meanwhile, Jammu Municipal Corporation through its Joint Commissioner PS Tandon filed status report as per the direction of the High Court dated May 7, 2009. The status report which was submitted by Advocate Shyam Sunder Nanda appearing for the JMC, interalia says that 89 banquet halls are functioning within the jurisdiction of JMC, of which four banquet halls namely Chander Bhaga community hall Bagwati Nagar the owner, Jambolachan Community Hall Mohalla Ustad, Ambedkar Community Hall situated Resham Ghar Colony and community Hall at Janipur Housing Colony owned by JDA are authorized whereas 36 banquet halls were constructed prior to inclusion of the area in JMC. Besides, four community halls owned by JMC and JDA, the other 85 private banquet halls have been declared unauthorized. The status report further reveals that 14 religious community halls constructed by various communities in different areas including Mahajan Bardari Bhawan Sabzi Mandi, Jain Bhawan Kali Jani, Khoranna Birdari Raj Tilak Road Jammu, Raj Pual Bhawan Amar Kashtriya Rajput Sabha meeting hall, Sher-e-Kashmir Bhawan Id-Gah Road NC Party Office, Brahaman Sabha, Dogra Saddar Sabha, Jain Bhawan Rani Park, Mahajan Hall Shalimar, Baba Balak Nath Digiana Rani Talab Temple Committee, Durga Palace Rampura Shastri Nagar Temple Committee, Janj Ghar Geeta Mandir Roulki Bakshi Nagar Jammu, Dewan Janj Ghar Sarwal Colony and Samriti Gurah Bakshi Nagar, are unauthorized. According to the status report the hotels used as banquet halls and declared unauthorized are Regal and Crystal Banquet Hall Hotel Asia, Nishat Banquet Hall Hotel Jehlum Resort, Mangal Varsha Banquet Hall Hotel TRG, Banquet Hall Karanti Hotel, Pealrs and Jewel Crown Banquet Hall Hotel Ritz Manor at Channi Thanger, New Karan Hotel Bakshi Nagar Jammu, Royal Treats Hotel Hari Niwas at Manda, Nandni Resort Hotel Ashok at Manda, Banquet at KC Residency, Banquet at Hotel Fortune Reveria, Banquet at hotel Premier Residency Road. Of these, 11 hotels have been constructed prior to the inclusion of the area into the JMC. This status report has been filed by JMC in a petition filed by Puran Chand of Pacca Danga Jammu and Bansi Lal of Shakti Nagar Jammu in which Advocate SK Anand appearing for the petitioners submitted that some banquet halls are being run without proper permission from the municipal authorities. It is stated that nuisance is being created by such like banquet halls which are operating illegally and further stated that even some banquet halls are operating in residential areas and the noise pollution is also being created by the said banquet halls as the music system is kept on for whole of the nights.
