| Court offers reprieve to banquet halls till Dec 31 | | | Early Times Report Jammu, May 22- In a much publicized closure of 85 banquet halls, Division Bench of J&K High Court Jammu Wing, comprising Chief Justice Barin Ghosh and Justice Muzaffar Hussain Attar, today recalled order dated May 7, 2009 whereby these banquet halls, operating within the municipal limits, had been ordered to be closed. This order was dictated in the open Court and while modifying the last order DB allowed these banquet halls to operate till December 31, 2009 and after the expiry of said date the earlier interim direction will automatically be revived. DB further issued directions to Pollution Control Board to ensure that noise level does not arose the permissible limits and in case any violation is reported the PCB would be at liberty to seize the said hall. The order, which is yet to be signed by the Division Bench, imposes various restrictions upon the banquet halls and also directs the owners to have fire extinguishers also. Division Bench also directed the police for regulating traffic outside the banquet halls. The owners of banquet halls have also been directed by the Division Bench to approach Jammu Municipal Corporation for licenses u/s 324 of Municipal Corporation Act and also directed the State to finalize the norms for running of banquet halls. These directions have been issued in a various CMPs filed by several people who have booked these banquet halls for the marriages of their children and also the owners of the banquet halls. In petition filed by Puran Chand and others in which Advocate SK Anand appearing for the petitioners submitted that some banquet halls are being run without proper permission from the Municipal authorities. It was stated that nuisance is being created by such like banquet halls which are operating illegally and further stated that even some banquet halls were operating in residential areas and the noise pollution was also being created by the said banquet halls as the music system kept on for whole the nights. In the status report filed by JMC, in which except four community halls owned by JMC and JDA, all the 85 banquet halls were declared unauthorized. JNF
