| Court rejects bail in rifle-snatching case | | | Early Times Report JAMMU, Jan 28: In a significant order, the Court of 2nd Additional Sessions Judge, Jammu, Anoop Kumar Sharma today rejected the bail application of an accused involved in a rifle-snatching and attack-on-police case, citing the gravity of the offence and the criminal antecedents of the accused. The bail plea was moved by Bagh Hussain alias Baghu alias Sunny in connection with FIR No. 54/2025 registered at Police Station Bishnah under Sections 109, 111, 121, 132 and 307 of the Bharatiya Nyaya Sanhita (BNS). As per the prosecution, the accused allegedly snatched an AK-47 service rifle from a police constable, assaulted police personnel during a recovery operation, and attempted to escape from custody, forcing the police to open fire in self-defence. Opposing the bail, the prosecution submitted that the accused is a habitual offender with as many as 22 FIRs registered against him in different police stations and that his release could endanger public safety and influence the investigation. After hearing both sides and perusing the case diaries, the court observed that bail in non-bailable offences is a matter of judicial discretion and that the seriousness of the allegations, attempt to escape from custody, and criminal history of the accused disentitle him to any relief at this stage. The court further noted that granting bail in such circumstances would send a wrong signal to society and adversely affect law and order, and accordingly dismissed the bail application.(JNF) |
