Court rejected bail of two police cops, one civilian

RAMBAN, May 25- Principal Sessions Judge Ramban Bala Joyti today rejected bail application of Nazir Ahmed Wani son of Aziz Joo Wani of Ramban a civilian, Mohd Ashraf son of Dilawar Khan of Ramban and Mohd Rafiq Naik of Chanchal Tehsil Ramban both police cops and all three are lodged in the District Jail Udhampur who are facing trial in a custodial death case.
According to the bail applications that FIR No 65 of 1998, a case for the alleged commission of offence u/s 302/34 RPC was registered against applicants and were taken into custody with effect from April 28, 2007 and since them they are languishing at District Jail Udhampur. It is alleged by the complainant Abdul Rashid Wani that his deceased son Ayaz Ahmed Wani was physically tortured by the petitioners and some others who succumbed to the injuries sustained by him, the accused committing the murder when his son was remained in police custody at police station Ramban. The case was transferred to Crime Branch; the Crime Branch after completion of the investigation presented the challan in the Court of law.
Principal Sessions Judge Ramban Bala Joyti while rejecting the bail application observed that according to public prosecutor that Abdul Rashid Kohstani has given clear version in his witness of whole occurrence showing active participation of accused persons in the gruesome murder of the deceased in police station. According to PP the accused persons even can be punished on the basis of trustworthy statement of even a single witness. Court considered the various plea put forth by both the sides and perused the entire record on the grant of bail, Court is of the considered opinion that it cannot be out rightly said that there is entirely no evidence about present applicants and also it cannot be denied that statements of various other witnesses of important nature and statement of various police officers of IPS cadre are yet to be recorded. Record reveals that out of 54 witnesses only 22 witnesses have been recorded and further observed that there are allegations against the accused persons/applicants that they had conspired and aided the absconding accused persons for the offence charge against them and referred a judgment and observed that Court do not find at this stage that the petitioners/applicants are entitled for grant of bail and Court rejected the bail applications of the accused persons.
