| Court granted five days relief to Anandrathi | | | EARLY TIMES REPORT JAMMU, MAY-25- 1st Additional Sessions Judge Jammu Puneet Gupta stayed the personal appearance of Anandrathi for five days. This order has been passed in a petition filed through the attorney holder of the Anandrathi, Chairman, Anandrathi Shares and Stocks Brokers Limiter Mumbai who aggrieved of the order dated May 12, 2009 passed by the CJM and the notice issued purportedly in terms of order of May 12, 2009, which was challenged. Gupta after goring through submissions of the counsel for the petitioner and the order dated May 12, 2009 and the notice in pursuance to the same, the court is of the view that as the petitioner is, for time being, only aggrieved of contents of the notice issued by the CJM Jammu, the petition can be disposed of at this stage with the direction that the records sought for by the Crime Branch (CB) be produced or caused to be produced by the petitioner Anandrathi as per the order May 12, 2009. So for the notice dated nil issued in pursuance to order dated May 12, 2009 is concerned, the direction issued to petitioner Anandrathi to personally attend the examination u/s 161 CrPC, the same appears to be not in consonance with the order May 12, 2009 as such the same is stayed for five days so that the petitioner can approach the magistrate in the meantime seeking correction of the contents of the notice. Court however made clear that court is not expressing any opinion of the point if the petitioner Anandrathi is to be examined or not u/s 161 CrPC in the investigations pending before the Crime Branch. With these observations Court disposed of revision petition filed on behalf of Anandrathi. It is worth to mention that a case was filed by Babita Balbir Singh wife of Ashok Kumar of Panama Chowk Jammu against Anandrathi.
