HC steps in, Raps JK Medical council for breach of natural justice

JAMMU, Feb 19: The High Court of Jammu & Kashmir and Ladakh at Jammu has stayed the operation of an order suspending an MBBS doctor's registration for two years, observing that the action prima facie appeared to have been taken without notice or opportunity of hearing, in violation of the principles of natural justice. Justice M.A. Chowdhary, after hearing Sr. Adv Amit Gupta for the petitioner, passed the interim order on 18.02.2026, granting relief to Dr Tanishq Gupta, whose MBBS registration was removed by the Jammu & Kashmir Medical Council (JKMC) vide order dated 07.02.2026, and whose application for registration of MD Psychiatry as an additional qualification was also rejected. The petitioner contended that the impugned action had been taken arbitrarily and without following due process, thereby depriving him of his livelihood. The Court, after preliminary consideration, recorded that a prima facie case was made out, noting that the order appeared to have been passed without affording the petitioner an opportunity of being heard. During the proceedings, counsel for the official respondents opposed interim relief, alleging misconduct and illegal practices against the petitioner. However, the Court held that, at this stage, the matter required closer examination and accordingly stayed the impugned order, directing issuance of notice to the respondents.
Notice was issued to the Union Territory of J&K, while notices on behalf of other respondents.
