SC remits Doda migrant’s case to State High Court
DB directs state, its functionary to file affidavits

Jammu, May 28- In a contempt petition filed by the Doda Migrants, the Division Bench of J&K High Court Jammu Wing comprising Chief Justice Barin Ghosh and Justice Muzaffar Hussain Attar, directed the state and its functionaries to file affidavits along with a chart showing the name of the applicant, number of migrants represented by him, date of his application, whether verification of his application has been completed or not and if completed whether accepted or rejected with the date and remarks, if any.
The Division Bench, after hearing Advocate HC Jalmeria, Additional Advocate General AH Qazi for the state functionaries and VK Magoo ASGI for Union of India, observed that this case has been remitted by the Supreme Court to the State High Court and from the order of the Supreme Court, it appears that while the petitioners in the contempt application contented that there are about 2201 families to relief measures, it was contended on behalf of alleged contemnors that they have already verified the cases of 1529 and purported to give an impression that there is no scope of verification of any further cases. They also gave an impression that whoever was entitled to upon such verification was accorded proper relief measures. These aspects of the matter have been stoutly disputed by the petitioners.
Division Bench further observed that after the matter was remitted to the High Court, thereupon for the first time, Division Bench had heard the parties after making great efforts to bring them before the Court and further said that the task that given to the state and its functionaries by this order, DB think, will keep them busy for some time and accordingly directed the Registry to list the matter in the week commencing July 6, 2009.
