Early Times Report JAMMU, Mar 10: A Special Judge, Fast Track Court (POCSO), Jammu, Amarjeet Singh Langeh has issued a show cause notice to the Investigating Officer in a minor kidnapping case after noticing serious lapses in the probe and failure to follow the procedure prescribed under law. The case relates to FIR No. 106/2024 registered at Police Station Pacca Danga, Jammu, under Sections 137(2), 61(2) of BNS and Sections 8, 15, 17 and 18 of the POCSO Act, in which accused Saifullah Ansari is facing trial. The Court observed that apart from the accused facing trial, two more accused-Shah Mohd and Manzoor Ansari-were also found involved during investigation. The Court noted that offences had been established against both the accused during investigation, but neither proceedings under Section 335 of BNSS were initiated against them nor were efforts made to arrest them. Instead, the Investigating Officer stated in the charge sheet that a supplementary challan would be filed after their arrest. Taking strong exception, the Court observed that the Investigating Officer had shown prima facie "absolute callousness" by not following the legal procedure in respect of the two accused who had allegedly evaded the process of law. The Court further said that in the name of filing a supplementary challan, law does not permit any "ostensible safe passage" to absconding accused, particularly in a case involving allegations of criminal conspiracy to kidnap a minor girl from Jammu & Kashmir to Mumbai. Accordingly, the Court directed issuance of a show cause notice to PSI Basharat Hussain, then posted at Police Station Pacca Danga, Jammu, through the Senior Superintendent of Police, Jammu, asking him to explain why legal procedure was not followed and why appropriate orders should not be passed.
