Petition for implementation J&K Juvenile Justice Act
DB directs state to file affidavit by July 26

Jammu, May29- In a petition, in the larger interest of society and Juveniles, seeking implementation of J&K Juvenile Justice Act, a Division Bench of J&K High Court Jammu Wing comprising Chief Justice Barin Ghosh and Justice Muzaffar Hussain Attar admitted petition to hearing and issued notice to the government for filling an affidavit on or before July 6, 2009. Advocate General, who was present in the Court, submitted that he has not yet received copy of the petition on this Advocate SS Ahmed, appearing for the petitioner, handed over the same to Advocate General in the Court.
The petition filed by Deepika Thussoo claiming to be social/human right activists and is actively involved in creating awareness towards child rights and issues pertaining to women, seeking directions to the respondents to strictly implement the J&K Juvenile Justice Act r/w J&K Juvenile Rules 2007 and also seeking directions to respondents to disclose before the Court the steps initiated towards the implementation of various provisions of the said Act r/w said rules and also seeking directions to respondents to place before this Court the steps initiated after the service of detailed legal notice dated January 13, 2009 seeking implementation of J&K Juvenile Justice Act 1997 r/w J&K Juvenile Rules 2007 in the letter and spirits.
Advocate SS Ahmed appearing for the petitioner submitted that the Juvenile Justice Act provides care, protection, treatment, development and rehabilitation of neglected or delinquent Juveniles and for the adjudication of certain matters relating to deposition of delinquent Juveniles. This Act came into force on April 1, 1998 vide SRO March 30, 1998. This Act repealed the J&K Children Act 1970 and comprehensive provisions uncorroborated from chapter I and VII providing for Juvenile Welfare Boards, Juvenile Courts, procedure in relation to boards and Juvenile Courts, Juvenile Homes, special homes, observation homes, after care organizations production of neglected Juveniles before Boards. Bail and custody of Juveniles and sitting of boards and Juvenile Courts, presumption and determination of age, prohibition of publication of names of Juveniles involved in proceedings under the Act and punishment for cruelty to Juveniles and prayed for strictly implementation of the J&K Juvenile Justice Act 1997 r/w J&K Juvenile Rules 2007 in the letter and spirits.
