Regularization of Daily wagers of RDD
HC directs respondents to pass appropriate orders

Jammu, June 01- In a petition seeking regularization of Daily Wagers, who were appointed in the year 1987 in Rural Development Department, Justice Nirmal Singh of J&K High Court Jammu Wing today directed the respondents to pass appropriate orders within a period of two months with regard to the regularization of the petitioners from the date their junior have been regularized. The Court also held that the petitions shall also be entitled to all the consequential benefits including monetary benefits.
These directions were passed by Justice Singh after hearing Advocate SK Anand appearing for the petitioners and Deputy Advocate General S Hakim appearing for the respondents. The Court observed that since Deputy Advocate General on the instructions of Director Rural Development Department, who was also present in the Court, made a statement that the petitioners deserve to be regularized from the date their juniors have been regularized and the case of the petitioners has already been processed and final orders with regard to their regularization is to be passed, the petition is being disposed off with the direction that respondents shall pass appropriate orders within a period of two months from the date of copy of this order is made available to them by the petitioner regarding regularization of service of the petitioners with effect from the date their juniors have been regularized. Petitioners shall also be entitled to all consequential benefits including monetary benefits.
This significant judgment was passed in a petition filed by Bharat Bhushan and Others in which Advocate SK Anand appeared. On the last date of hearing Commissioner /Secretary to Government and Director Rural Development Department were directed to appear in person along with record to indicate the reasons why the services of the present petitioners have not been regularized. In pursuance to the said order JL Bhagat Director RDD appeared in person but the Secretary to Government RDD was not appeared. An application for exempting his presence for today was moved which was allowed.
The Court further directed that in case the services of petitioners were not regularized within the period of two months then the petitioners shall be at liberty to seek revival of this petition and the respondents Commissioner/Secretary to Government and Director RDD shall cause their presence on the date the petition is listed.
