| Court awards 8 years RI to Pak trained HM militant | | | EARLY TIMES REPORT Rajouri, June 02- Principal Sessions Judge Rajouri Subash Chander Gupta today awarded eight years rigorous imprisonment to Mohammed Jameel son of Mohammed Hussain of Metak Tehsil Kalakote, a Pak trained HM Militant, who was apprehended during the search operation on May 21, 1997 and recovered AK-47 Rifle pistol made in China, pistol magazines, pistol rounds and other material from the possession of the HM militant. While awarding sentence the Principal Sessions Judge, after hearing both the sides, observed that the accused is facing incarceration of trail right from 1997 as such he would have certainly suffered with trauma pain and agony of protected trial in the present case. On the said consideration, the Court taking lenient view sentences the accused in the present case for the commission of offence u/s 3/25 and 7/25 Arms Act which stands proved against accused by the prosecution beyond all shadow of doubt. The Court is of the considered opinion that ends of justice would be met in case, the accused Mohammed Jameel is sentenced to minimum punishment provided for commission offences mentioned above and accordingly accused Mohammed Jameel is sentenced to rigorous imprisonment for three years with a fine of Rs 2000 for commission of offence u/s 3/25 Arms Act and the accused is further sentenced to rigorous imprisonment for five years and fine of Rs 2000 u/s 7/25 of Arms Act. Both the sentences shall run concurrently, the Court ordered. JNF
