| Delimitation | | BJP vows to take case to SC | | Early Times Report Jammu, June 03- The State Unit of BJP has decided to challenge the Jammu and Kashmir High Court decision dismissing Public Interest Litigations seeking delimitation of Assembly seats in Jammu and Kashmir in Supreme Court of India. Addressing media persons here today the BJP spokesperson Ramesh Arora, who had moved a CMP to be impleaded as party petitioner in PIL No. 24 of 2007 which came to decided on June 2 by the State High Court dismissing the main petition, said that after going through judgment we are of the opinion that responsibility of legislature to legislate on the subject became more necessary as the High Court has come to the conclusion that it is prerogative of the assembly regarding the provision under challenge. He said the High Court has not touched many points as per our understanding and have explained the legal position in brief. BJP has decided to approach Supreme Court of India and will challenge the order of dismissal as interest of general public is involved, he added. Arora said that we had requested the High Court that the petition relates to the basic concept of democracy and it was submitted that enormous population explosion had taken place in Jammu province necessitating the constitutional provision in order to strengthen the democracy in Jammu and Kashmir particularly in Jammu province by enhancing the number of seats propionate with the growth of population and changing from reserved to de-reserved or otherwise. High court has not touched this fact which was necessary to arrive at a just conclusion and important to give interpretation to legislation under challenge, he said. Arora said that all the elected MLA and political parties have moral responsibly to pass legislation with regard to delimitation of assembly seats as this judgment will not stand in their way to legislate on the issue as this is a matter of public concern and we owe commitment to public to remove this discrimination. “ We are committed to end this discrimination and will not leave any stone unturned and want to make it clear to Congress, National Conference and PDP that BJP will not compromise on the basic issue and will raise the matter in all forums available’, he maintained..
