| HC comes to the rescue of ex-serviceman | | | Early Times Jammu, June 03- Coming to the rescue of an ex-serviceman who had applied for the post of forester under Ex-Servicemen category advertised by SSRB on September 14, 2004, Justice Nirmal Singh of Jammu and Kashmir High Court Jammu Wing today directed the respondents that the petitioner’s name be also sent to State Government for appointing him against the available post of forester under the ex-serviceman category. Taking serious view of the functioning of state officers/officials Justice Singh said that respondent state has chosen not to file the objection to the present petition and there is no representation on behalf of the said respondents. Where the officers/officials of the state Government have not adhered to their own instructions or circulars, they chose not to come forward to defend their action. This is not isolated case in which there is no representation on behalf of state Government but there are number of cases where the officers/officials of the state Government had chosen not to defend the cases for the reasons best known to them. Taking into consideration the facts and circumstances of the case and the statement made by Advocate SK Shukla appearing for the SSRB in which he submitted that the petitioner is only candidate in the category of ex-serviceman, therefore, SSRB are directed to open the sealed cover and declare the result which was earlier ordered by the Court that the result of the petitioner be kept in the seal cover, the Court directed that after doing the needful the petitioner’s name be sent to the state Government for appointment against the post of forester under the ex-serviceman category and also directed the respondents that the exercise be completed within two months.
