| Attack on Forest Guard | | Court awards four yrs imprisonment to accused facing trail for 8 yrs | | Kathua, June 03- Principal Sessions Judge Kathua Katar Singh today in a case of attack on forest guard awarded four years imprisonment to Krishan Chand alias Faqiru son of Basant Giri of Parole Tehsil Kathua who was facing Trial from the last eight years. Principal Sessions Judge after hearing Public Prosecutor BB Sharma appearing for the state and Advocate Dewakar Sharma appearing for the accused and going through the case along with the statements of the prosecution witnesses, observed that the accused facing trial in this Court since June 10, 2002 has a clean record and on medical report issued by doctor that the injuries have not been proved grievous but the statement of the doctor that injuries sustained were simple in nature and caused by a sharp edged weapon, so offence committed by the accused fall u/s 324 and not u/s 307 RPC. The accused Krishan Chand is convicted and sentenced to undergo imprisonment for a period of one year u/s 324 RPC and pay fine of Rs 500, the accused is further sentenced to undergo imprisonment for a period of three years for the commission of offence falling u/s 4/25 Arms Act and fine of Rs 2000. Court further clarified that the sentences shall run concurrently. According the prosecution case on March 3, 2002 complainant Sikander Lal serving as a forest guard lodged oral report in the police post Parole in an injured condition stating that about 9.45 am he was going to attend his duty at Kathua on Motorcycle and one Uttam Chand was pillion rider on his motorcycle and when he reached near Khakhyal accused Krishan also came on his scooter and after crossing his motorcycle, he stopped his scooter in front of his motorcycle and wrongfully restrained him and brought out Toka and started inflicting injuries on his head, he tried to ward-off the blow with his hand as a result of which he sustained injuries on his left hand. Some persons came on spot and the accused ran away. A case u/s 307/341/323 RPC r/w section 4/25 Arms Act was registered and the accused was arrested. On his disclosure, toka was recovered and after completion of the investigation challan was presented in the Court of law. JNF
