| Fake qualification certificate case | | Court awards 3 yrs RI to accused after 12 yrs trial | | Early Times Report Jammu, June 05- After 12 years of trial, the Chief Judicial Magistrate Jammu YP Bourney today awarded three years rigorous imprisonment to Swarn Singh for obtaining fake marks sheet of matriculation examination and getting himself enrolled in the Army. CJM, after hearing Chief Prosecuting Officer Pawan Kumar Khajuria appearing for the state and the counsel for the accused, observed that from the evidence on record it has been established that accused intentionally and purposely produced a fake mark certificate of matriculation for his enrolment in Army which he otherwise might not have got. In this way he not only cheated Army Recruitment authorities, but also other aspirants. Evidence led by the prosecution does not suffer from any of the vices and none of the witnesses examined had any axe to grind against the accused, which were not even known to them. Thus evidence led by the prosecution is cogent and trustworthy. The Court, accordingly awards rigorous imprisonment of two years and fine of Rs 5000 u/s 420 RPC and one year rigorous imprisonment and fine of Rs 2000 u/s 471 RPC to the accused. However, both the sentences shall run concurrently, the Court ordered. During the investigation, the Crime Branch found that the accused had obtained fake certificate under Roll No 22296, Session April-May 1988 and had got enrolled in Army with effect from March 26, 1989.The marks sheet of accused was sent to Joint Secretary State Board of School Education and was found to be fake. The Army authority conducted the enquiry and discharged the accused from service on February 15, 1996. The investigation concluded with the finding that accused had committed offence punishable u/s 420, 471 RPC and the challan was presented in the Court on July 23, 1997. JNF
