| Court awards life term to accused in murder case | | | Early Times Report Reasi, June 06- Principal Sessions Judge Reasi AK Koul today awarded life-imprisonment and fine of Rs 10,000 to accused Krishan Lal son of Nek Ram resident of Salal Tehsil Reasi, for committing murder of one P. Vedha Lingam an employee of AFCON Railway Company. The Court held accused guilty of committing house trespass by forcing entering in the house of deceased to kill him. Accused used his license 12 bore gun to commit the crime. Thus the accused is proved to have committed offence u/s 302/450 and 27 Arms Act. He is accordingly convicted of commission of said offences. While awarding sentence the Judge observed that the accused has committed a very serious crime of murder of deceased with a licensed weapon. The crime is truly grave but it cannot be considered as rarest of the rare case. It is almost a rule now that the normal sentence for the offence of murder must be imprisonment for life unless the circumstances pointed out that the criminal is menace to the society. Court is of the view that ends of justice demanded that commensurate punishment for the crime committed by the accused would be imprisonment for life and not the death sentence. Since the prosecution has not been able to make out a case for maximum punishment prescribed under law, the accused is therefore sentenced to imprisonment for life u/s 302 RPC along with a fine Rs 10,000. The accused Krishan Lal, an employee of PWD, on March 6, 2005 came to the rented accommodation of the employees of AFCON and demanded ransom posing himself as “Gunda”. On refusal, the accused threatened the deceased who was then store-keeper of the AFCON and at about 10.15 PM on the same day the accused came there with 12 bore gun and shot at the deceased. The accused managed to escape from the scene. The deceased in an injured condition was shifted to hospital where he recorded his statement and succumbed to injuries. A Case u/s 302/450 RPC r/w section 3/25 Arms Act was registered. After completion of the investigation, challan was presented in the Court of law. JNF
