| Court acquits accused facing trial in dowry death case | | | Early Times Report Samba, June 8: Principal Sessions Judge Samba Suresh Sharma acquitted one Bansi Lal son of Ludar Mani of Samba who was facing trial for committing murder of his wife for dowry. After hearing Public Prosecutor for the state and Advocate Subash Singh Sambyal appearing for the accused, Principal Sessions Judge observed that dying declaration, upon which the prosecution relies, does not inspire confidence as it is doubtful and suspicious considering the condition of the victim who had sustained more than 90% burnt injuries. In fact it was recorded by the SHO that no witness was produced in this case and more so the doctor who was admittedly present on spot and in whose presence the so called dying declaration was recorded was neither arrayed as witness nor produced by the prosecution. Further the prosecution evidence that the accused used to harass and treat the victim with cruelty belongs to realm of hearsay. With these observations Court acquitted the accused of the charges leveled against him. According to the prosecution case on October 13, 2004 when the victim Anuradha was working in kitchen and preparing food, the accused, was also present there, took a bottle of kerosene oil and poured the same on her. She caught fire and called her aunt for help but she did not come on spot. While trying to extinguish fire she got badly burnt. She was brought in the hospital where she recorded her statement. She submitted that she had got married four years ago with the accused Bansi Lal. A child aged 14 months was born out of the wedlock. Accused was earlier working in Army; however, he left the Army after one year and came home. During the last two years he had been severely beating her and pressurizing her to bring more money from the parents. She said that his brothers are poor and cannot afford to pay money to her as being demanded by the accused. A case u/s 302/498-A RPC r/w section 2, 3, 4 Dowry Prevention Act was registered and after completion of the investigation challan was presented in the Court of law.
