HC recommends compensation of rs. 4.80 lakh as cop electrocuted due to PDP negligence

Jammu, JUNE 10:Justice Mansoor Ahmed Mir of J&K High Court Jammu directed Power Development Department to pay compensation Rs 4, 80, 000/- to the legal heirs of the deceased Noor Mohd who was electrocuted due to negligence of PDD.

In the petition filed by Noor Bibi and Ors claiming compensation on the ground that deceased Noor Mohd died in the harness on November 29, 2000 due to negligence of respondents. It is averred that the respondent Power Development Dept failed to maintain high transmission lines of electricity in Phallain Mandal Area of Jammu District. It is stated that the said high transmission lines broke down and fell on the low tension wires which converted the low tension wire into high tension wires, due to which the fire broke-out and cause damaged to the property of the residents of the said area and at the relevant point of time deceased Noor Mohd who selection grade police constable was performing his official duty become the victim of the said incident, sustained injuries and succumbed to the same. The petitioners have claimed compensation to the tune of Rs 15 lacs.

Justice Mansoor Ahmed Mir after hearing Adv Ajay Gandotra appearing for the petitioners and Deputy AG S Hakim appearing for the respondents state and PDD observed that Noor Bibi widow of the deceased has lost the source of dependency and matrimonial life, petitioner’s son and daughter have also lost and affection and parents of the deceased have also lost son and source of their help in their old age. With these observations this petition is allowed and the petitioners are held entitled to compensation Rs 4, 80, 000 and directed the respondents to deposit the amount before the Registry of High Court within a period of three months, in default petitioner shall be entitled to 6% interest from the date of presentation of this petition till its realization.
