Allotment Haj Seats to Jammu Muslim
HC directed to submit criteria for fixing the number of Hajies

Jammu, September, 25:- In a much publicized writ petition against discrimination with Jammu Muslims in allotment of Haj Seats, Justice JP Singh today after hearing Additional Advocate General Mr. AH Qazi appearing for the state respondents and Advocate S M Choudhary, SS Ahmed appearing for the petitioners, Mr. Mayank Gupta CGSC appearing for the Union of India, allowed the time for filling objections to the state as prayed by the AAG and in the meanwhile Court directed Mr. Qazi that he shall have instructions from Divisional Commissioner Kashmir as to what criteria had been adopted by him in fixing the number of Hajies from Jammu and Kashmir Provinces fro this years.



This Court direction has been issued in writ petition filed by Choudhary Maqbool Ahmed and others of Districts Jammu and Rajouri in which it has been submitted that the petitioners have been discriminated by the convener State Haj Committee Srinagar in allocating the seats for the Haj Pilgrimage of 2006-II, the said respondents did not adhered strictly to the criteria for allotment of seats in accordance with the figures senses 2001.



The petitioners took up the matter with the Divisional Commissioner Jammu and the Div Com Jammu vide letter dated August 30, 2006 clinched the entire issue and informed the Convener State Haj Committee, that as per the Muslim Population of Jammu Division, the total seats worked out 1321 as against 976 worked out by the Convener State Haj Committee. It is further submitted that only 1287 applications have been received in six districts of Jammu Division. Had there been proper allotment of 1321 seats by the Haj Committee, there would not have been any question of holding competition or qurrah and all the applicants would have allowed performing Haj 2006-II. The petitioners prayed before the Court for issuance direction to Convener State Haj Committee to strictly adhere to the norms/criteria by the Chief Executive officer Haj Committee of India regarding the allocation of seats for Haj 2006-II, which mandates the allocation of seats as per the population of the district concerned and also seeking direction to the respondents to reallocate the vacant/ left over seats of Districts Kathua, Doda and Poonch to Jammu, Udhampur and Rajouri Districts of Jammu province where the number of applicants is more than seats allotted.
