| KOOL Constructed for the use of agriculture purpose diverted to hotels | | HC restrained respondents from diverting waters of the KOOL | |
Jammu, September, 25:- Justice JP Singh of J&K High Court Jammu Wing in a writ petition filed by the Villagers against diverting the Kool for supply of water to Kud, Patnitop and other areas, has restrained the respondents from diverting the water of the Basht Channel (Kool) and also ordered not to interfere in the use of its water by the petitioners. Court after hearing Sr. Adv SS Lehar with Adv Akshay Anand appearing for the petitioners issued notice to State of J&K through Chief Secretary, Commissioner/ Secretary Public Health Engineering Department, Chief Engineer PHE Jammu, Executive Engineer PHE Division Udhampur returnable within one week.
During the course of arguments Sr. Adv SS Lehar submitted that the respondents have already utilized 30 % water from this channel through a pipe of 30 inches diameter and this water is supplied to Kud, Patnitop and other areas. The 98% of the population of the area is having agriculture source of their income and if the water is taken away by the respondents, the people of the area will suffer lot.
The petition filed by the villagers through Krishan Singh, Des Raj, Sham Chand and Sajjad Hussain of these villages submitted that from Nallah Shiv Garh, there are 13 water channels and out of these one water channel (KOOL) was constructed by the irrigation department in 1978. This Basht Kool irrigates 66 hectors of land and it is the only source of irrigation for this land of three villages. They alleged that the Kool water was diverting to Kud, Batote and other areas for supply of waters to Hotels and others.
