| HC stays transfer of CAPD official | | | Early Times Report Jammu, June19- Vacation Judge of J&K High Court Jammu Wing Justice JP Singh today, in a petition filed by Chet Singh Store-Keeper in CAPD, who was allegedly transferred at the behest of some local political leader, stayed the order of CAPD dated June 10, 2009 pertaining to the transfer of the petitioner. Petitioner Cheet Singh in his petition filed through Advocate Sudershan Sharma submitted that respondent Director CAPD Jammu has passed an order dated June 10, 2009 which is a partial modification of order dated June 8, 2009, whereby petitioner has been directed to remain attached in the office of Assistant Director CAPD Kishtwar. It was further submitted that no reason has been mentioned in the impugned order for keeping the petitioner in attached capacity by modifying the earlier general order of transfer which was required to be assigned by the said respondent while modifying the earlier order of the transfer and the order impugned has been passed without seeking approval from the administrative department. The petitioner submitted that the order impugned is actuated with malafides and has been passed with oblique motive only in order to adjust some other employee at the place of the petitioner, at the behest of some local political leader, otherwise there was no occasion to pass the order impugned as the same has been passed in a haste manner without seeking approval and prayed for staying the order impugned.
