| HC upholds PSA detention of Poonch man, dismisses habeas corpus plea | | |

JAMMU, Sept 28: The High Court of Jammu & Kashmir and Ladakh has dismissed a habeas corpus petition challenging the preventive detention of a Poonch resident under the J&K Public Safety Act. Justice Sanjay Dhar declined to interfere with the May 5, 2025 detention order passed by the District Magistrate, Poonch against Mohd Qayoom of Village Qasba, Haveli, under the Public Safety Act on grounds relating to security of the State. The petitioner had argued that the detention was primarily based upon FIRs dating back to 1989 and 1992 and that these were stale incidents without a live or proximate connection to the detention order. He also raised objections regarding supply and explanation of the detention material and consideration of his representation. The Government contested the plea, maintaining that the detention was based upon material including more recent alleged activity and that all procedural requirements had been complied with. After examining the detention record, the High Court found no ground warranting interference and dismissed the petition along with connected applications. (JNF) |
