Lecturer not allowed joining at the behest of MLA
HC issues notice to MLA, Govt.

Jammu, June 22- Coming to the rescue of the newly appointed Lecturer, Vacation Judge of Jammu and Kashmir High Court Justice J P Singh today directed the respondents to allow him to join at his place of posting and also directed Registry to list the case after two weeks.
The petitioner in his petition submitted that he was duly appointed as a lecturer and adjusted in HSS Sarthal, but was not allowed to join at the behest of MLA concerned. Justice Singh, after hearing the counsel for the petitioner Surinder Kour, issued notice to GM Saroori MLA Inderwal, Chief Secretary, Commissioner/Secretary School Education, Director School Education Jammu, and Principal Government Higher Secondary School Sarthal District Kishtwar and directed the respondents to permit the petitioner to continue functioning in the school.
The petitioner submitted that he was selected and appointed as lecturer in Mathematics and adjusted in Higher Secondary School Sarthal (Kishtwar) vide order No DSEJ/ GAZ/ PS/6550-6635 dated May 29, 2009 issued by respondent. In pursuance to his appointment, the petitioner submitted his joining report before the Principal Government Higher Secondary Sarthal on June 2, 2009. According to Advocate Surinder Kour the Principal was telephonically informed by the PA to the Director School Education Jammu that the petitioner shall not be allowed to join in view of the corrigendum issued in the said order. It was admitted by the Principal that the petitioner submitted his joining report but the petitioner could not be allowed to join because of the instructions issued by the higher authorities. In the petition it has been alleged that the corrigendum was issued on political influence of MLA Inderwal as the MLA wanted to adjust his favourite in place of petitioner and openly declared that he will not allow the petitioner to join in his constituency as the petitioner had not voted for him. The petitioner sought quashment of corrigendum and also directions to the respondents to allow him to join at Higher Secondary School Sarthal. JNF
