BCFI demands disbanding of J&K State Commission for BCs

The Backward Classes Federation of India (BCFI) taking strong notice of news appeared the News Papers a few days ago with regard to “submitting of Annual Report by the J&K State Commission for Backward Classes” has demanded disbanding of State Backward Classes Commission and resignation of Chief Minister and Dy Chief Minister.
Addressing a pres conference here today President of Association Manohar Lal accompanied with Mukhtiar Kalia General Secretary criticized the said report and said that reference of inclusion of almost 90% of the area of J&K State into RBA and ALC which is totally unlawful, illegal, unconstitutional and against the wishes and aspiration of the framers of the Constitution of India, especially Baba Sahib Dr Bhim Rao Ambedkar.
‘So, the BCFI which represents almost 85% of the population of J&K State viz. the Backward Classes i.e. OBCs, SCs & STs from all walks of civil society demands the resignation from the Chief Minister and the Dy. Chief Minister as the duo has failed to provide justice to the Backward Classes and cater to their aspirations as per the provisions of Constitution of India viz-viz the Constitution of J&K State, they said.
Mentioning that the base of Reservation is Article 15 (4), Article 16 (4) and Article 340 of the Constitution of India, the term used in these Articles is “Socially and Educationally Backward Classes ” as per Article 15 (4) and Article 16 (4), which come under Fundamental Rights i.e. part-III of the Constitution of India, areas like RBA & ALC find no place, speakers said and added that Supreme Court had already decided this issue in Mandal Judgment in the case titled “Indira Sawhney & Ors. V/S Union of India & Ors.”, in the year 1992 by a Constitution Bench of nine Judges, and rejected “Area” as basis for Reservation.
They said even the National Commission for Backward Classes had already rejected RBA & ALC Reservations; therefore, these unconstitutional Reservations find no place in Centre Government and in the light of the above said examples BCFI demands disbanding of “Present Permanent J&K State Commission for Backward Classes” as it is working totally in contravention to the provisions of Constitution of India, the Constitution of J&K State.
The speakers further demanded Reorganization of J&K State Commission for Backward Classes with all its members including Chairman only from OBCs i.e. from the list of castes mentioned in Annexure-D of SRO 294 and implementation of 27% Reservation in favour of OBCs as per Mandal Commission Recommendations and Supreme Court Judgment.
