| Court sentences 10 yrs RI to 4 drug traffickers | | | Jammu, Sep 26 : Second Additional Sessions Judge Jammu AK Koul has today convicted four persons for drug trafficking under Narcotic Drugs and Psychotropic Substance Act and sentenced them to undergo rigorous imprisonment of ten years and a fine of one lakh, each. Passing judgment in case titled State V/s Uttam Singh and others, the court held that the accused, Uttam Singh s/o Sewa Singh R/o Mohalla Utad, Jammu, Jasvinder Singh s/o Roshan Lal R/o Sanjay Nagar, Tarseem Singh son of Om Parkash and Opinder Singh son of Dhanpat Singh, the prosecution has established its case and the accused have committed an offence under section 8 (C) NDPS Act as they were in possession of commercial quantity of Heroin. “I Hold them guilty for commission of the offence under section 8 (C) R/W Section 21 of NDPS Act and accordingly I convict them”, Judge AK Koul held, while passing the judgment. However, the court observed that the accused are in custody since last two and a half years as such the minimum sentence prescribed under law, would meet the end of justice. It was further observed that the urgency or concerted action for prevention of drug menace can hardly been over¬emphasized as there may hardly be any part on the globe where the curse of drug trafficking and drug addiction may not be prevalent. National Policy on Narcotic Drugs and Psychotropic substances is based on the Directive Principles contained in Art. 47 of Indian Constitut1on which directs that the slate shall endeavor to improve Public health, observed the court. After hearing APP for state and defence lawyers, Advocate Sunil Sethi, Advocate Chada and Advocate Devki Nandan, the court convicted all the four accused and directed them to go rigorous imprisonment of ten years. As per the police story, on 27-03-2003 police was informed by its sources that the accused were carrying Brown Sugar and Heroin outside the state n their Maruti Car. A special Naka was laid down the police at Shakti Nagar Jammu and the accused was intercepted at around 21:25 hrs in the Maruti Car No 7659-JK02K. The naka party, in presence of the an Executive Magistrate, recovered one Kgs of Heroin from the possession of three accused and one and half kgs of Brown Sugar from the possession of two other accused. |
